Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Tractex (“Tractex,” “we,” “us”). By creating an account or using Tractex, you agree to these Terms. If you use Tractex on behalf of an organization, you represent that you are authorized to bind that organization.
Accounts and organizations
- Tractex is organized around workspaces (organizations). Data — saved parcels, notes, pipeline, and settings — is shared among the members of a workspace.
- You are responsible for your account and workspace, for the accuracy of the information you provide, for your members’ activity, and for keeping credentials secure.
- You must be able to form a binding contract and use Tractex only for lawful purposes.
One seat, one person
- Tractex is licensed by the seat, and each seat is for one named person. A seat’s sign-in may not be shared among, or passed between, more than one individual — including colleagues in the same organization.
- We ask every workspace to uphold one person per seat. If more people need Tractex, add a seat for each of them; your seats, and who holds each one, are shown in Settings, under Team & seats.
- You may move a seat to a different person when someone joins or leaves your team. Rotating one seat among several people so that more of them can use Tractex than you have seats is sharing, and is not permitted.
- A sign-in may be in use on one device at a time. If it is opened on a second device while it is in use on the first, Tractex asks which one to keep and signs the other out. Switching between your own devices is not affected.
- We may contact you, require additional seats, or suspend a seat that we reasonably believe is being shared, consistent with the Termination section below.
Acceptable use
Your use of Tractex is subject to our Acceptable Use Policy, including the rules on data redistribution and on lawful, non-harassing contact with property owners. Violations may result in suspension or termination.
Data, estimates, and no professional advice
Tractex presents information from public government records and algorithmic estimates that may be inaccurate or out of date. This is central to these Terms and is described in our Data Disclaimer, which you should read in full. Tractex is not legal, financial, title, survey, appraisal, or brokerage advice, and you must independently verify every material fact before acting.
Workspaces and their owner
A workspace belongs to the organization that pays for it. The person who buys its seats is its owner: they manage its seats, its billing, and who is invited, and they cannot be removed by another member. The owner may transfer ownership to another member of the workspace. Content added to a workspace, such as saved parcels and notes, stays with the workspace when a member leaves or is removed.
Subscriptions and billing
- Paid plans, pricing, billing cycles, and features will be presented before checkout. Fees are billed in advance for the applicable period.
- A free account includes a limited daily allowance and some features only, as shown in the product. We may change what the free account includes at any time.
- Plans are priced per seat, and a seat is one person (see “One seat, one person” above).
- Seats added during a billing period are charged for the rest of that period. Seats you remove take effect right away and are not refunded. A yearly plan is paid in advance for the year.
- Paid subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You can cancel at any time; cancellation takes effect at the end of the current period.
- Except where required by law, fees are non-refundable. Any refund policy in effect at purchase will be disclosed at checkout.
Intellectual property
Tractex, its software, and its design are owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use Tractex under these Terms. You retain ownership of the content you add to your workspace (such as notes).
Termination
You may stop using Tractex at any time. We may suspend or terminate access for violation of these Terms or the AUP, for non-payment, or as needed to protect the service or others. Provisions that by their nature should survive termination will survive.
Disclaimers and limitation of liability
Tractex is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any decision made in reliance on the data or estimates Tractex provides. Our aggregate liability is limited to the amounts you paid for Tractex in the twelve months before the event giving rise to the claim.
Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules, and Verbolta LLC is the contracting entity.
Changes
We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date, and your continued use after changes take effect constitutes acceptance.
